The basic army structure in AACW is as follows:
1. Elements - the smallest discreet block in the game. Basically equivalent to a battalion of 1000 infantry and cavalry.
2. Brigades - the smallest independent units in the game (you can't split brigades into each of their elements). Can be anything from 1 to 7 elements.
3. Division - can have anything up to 18 elements to a division. Since brigades have variable element sizes, this can be anything from 3-17 brigades, plus one element for the leader. This is the only hard and fast number limit in the game.
4 Corps - No hard limit as such, but there is a command point soft limit of 16. Commanders usually contribute 2*star level to each corp, doubled if in a division, to a max of 16 points. Brigades tend to use up 0.5-1 command points per element, divisions - 4 command points (so can be as low as 2/9ths per element, therefore much more effective to put all your brigades into divisions).
5. Army stacks, are much like corps stacks except they don't initiate combat, so best used in a supporting role to corps. There is no limit to how many corps you have in an army, but you cannot create one outside the army commanders range (based on his stats).

For additional clarification on Divisions above am I understanding correctly that the limit of 18 elements in a Division includes the individual elements of the brigades themselves? That looks like what you said, but I want to make sure I'm understanding it correctly.
Yes, that's correct, so if brigades are 1-7 elements, then you should be able to get 4 brigades in a division on average.

Since were on the topic I'm also confused. just 5 or 6 questions 
1)When you create a division (based on 1.05a), you simply go to a stack with a general, highlight the general and hit the "enable divisional command" button?
2) Are the individual units (brigades, etc) in that stack automatically part of the division?
3) What indication is there that it is in fact a division? does the division commander's title turn gold as it does for a Corps or Army commander?

I don't think I'm doing it right for some reason.
The tutorial has a part on that, where it refers to Crittenden 5th division: If I remember well you are asked to ctrl-click on some units and then hit the (+) button so they gather in a division.
