Problem with recruitment of colored troops

I played a game recently as the Union where I was attempting to provoke the foreign intervention (just to see what it was like). When the "recruit colored troops" option became available, it did it, but I deliberately delayed selecting the "emancipation proclamation" option to avoid taking the hit on foreign intervention points. Between the time of selecting "recruit colored troops" and when foreign intervention was triggered, I was unable to actually recruit colored troops (the brigades did not appear as options in the reinforcements box). I figured this was because I didn't trigger the emancipation proclamation. After foreign intervention occurred, however, and I finally DID trigger the EP, I was still unable to recruit colored troops. Is this a bug perhaps?

I don't think the 2 problems I related, this is the EP which should give you the brigades, whatever the other option. Have you waited some turns?
