I would have thought that they should be unlocked on entry to the game if the Foreign Entry trigger has already fired and then be available for immediate use by the Confederates. [In the converse situation playing as the Federals I've witnessed the AI getting full use of the French units, romping all over the West!]
I have been wondering about the intent behind locked foreign troops as well. I actually had the foreign intervention occur in a PBEM playing as the Union.
One of my initial Mexican armies was unlocked. So I moved the army on Houston and captured it. However the CSA moved their own armies in and surrounded it. I finally evacuated the Mexican troops by sea to Louisiana as I couldn't get them back to Mexico. Since then, I have received two new Mexico reinforcement divisions in the same Louisiana location as my originally evacuated Mexican troops. And now, they are permanently locked in Louisiana. Which doesn't make sense to me as I cannot return them to Mexico now even if I wanted.
