OK, found out what is happening.
My AV was quarantining empires.exe every so often, thought it was a threat.
Have now added it as an exception.

Have never had this issue with any other game, what makes the empires.exe so special??????

Just start a new game as Rome and run for several turns.
Look at the Legacy points tooltip in the top right hand corner of the screen, check it each turn.

You have to be in offensive posture to use the button.
If you still can't select it once you have changed the posture, then you will have to de-select the fleet and then re-select it. You will then be able to use the intercept button.
